Jeremy Piven opened his car door Tuesday -- no big deal. Problem was ... he didn't look first and a bicyclist slammed into the door, cutting his chest open. 

Law enforcement sources tell TMZ ... Jeremy was near The Grove when he parked his car next to the curb and flung open the door of his 2015 CTS Cadillac. The 35-year-old man who was peddling along was badly hurt and taken to the hospital by ambulance.

Our cop sources say they believe Jeremy was at fault but he didn't get a ticket because cops didn't see it happen. We're told Jeremy was cooperative.

The victim received stitches on his chest. Too early to know about a civil suit, but you can bet on it.

We reached out to Piven ... so far no word back.

I agree.  

Here's the applicable California statute:

22517.  No person shall open the door of a vehicle on the side available to moving traffic unless it is reasonably safe to do so and can be done without interfering with the movement of such traffic, nor shall any person leave a door open upon the side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers.

Police do not have to personally see a dooring to give a ticket or charge someone for it.  Since when has it been a rule that the police have to actually see an incident happen before anyone can be ticketed or charged?  Nonsense!

When someone opens a door into traffic and someone else runs into it, especially a relatively slow-moving bicycle, it can be inferred that it wasn't reasonably safe to do so.  Especially if the cyclist tells the cops that the door opened suddenly right before he ran into it.  This statute places an affirmative duty on the motorist to make sure that traffic is clear before opening the driver's side door.   

The police probably just don't want to charge Jeremy Piven.  Maybe he gave them a few autographs or posed for a picture.

And, according to TMZ, "Police said the 'star' was at fault." Still no ticket/charges.

I suspect that Erick Netterblad was struck by some cash.

IMHO, Mr. Pivens doorings have never suspended my disbelief.

Maybe they can "hug it out" and all's forgiven for Piven.

So police in L.A. won't arrest anyone for murder if they don't see it happen?

Police cannot give a ticket if they do not witness and their is no complaint. Was there a complaint filed by the cyclist?

Who is Jeremy Piven?

This is just like how a DUI works right? The police need to actually see you drinking alcohol and then see you driving.
