Who's defense are you concerned about? San Hamel's?
He is the only one needing defense; It's too late to try and defend Bobby Cann.
Those defending San Hamel would find a petition avoiding plea bargaining to be objectionable, I'm sure.
Some of us are very busy in other things and can't get involved in every issue. But that doesn't stop us from wanting to get information, factual information.

Communication has been excellent to those who followed instructions to be kept in the loop and to participate. A decision was made to keep planning and discussion somewhat out of the public eye, which was a partial reaction to the mess that initially happened when supporters of the perp and the victim were batting it out on this forum, and well-meaning but poorly informed people were taking ill-advised steps such as circulating petitions for things the defense may not have wanted....

Regardless of what happens to San Hamel, the greatest impact that could be had would be for this to be publicized as much as possible. Have people collect signatures, pass out flyers, whatever. It seems to me that while you guys are working at winning in the court of law, you are making no ground in the court of public opinion. The more people who know and who are outraged about this the better -- whether or not it helps the prosecution. I find this whole hush hush attitude for the sake of some dumb protocols they taught in law school counterproductive and disturbing.

Hello all.
The arraignment took place Friday. A judge and a courtroom were assigned to the case, the defendants attorneys entered a plea of not guilty and the next court date of Sept 18th has been assigned.
To clarify, individuals trained by the Chicago Police Department as Courtroom Advocates have been requested by their CPD trainers to err on the side of caution when discussing the case. As the liason to the CPD Community Policing Office with respect to this particular case, we have (and will continue to) follow their lead in that vein.
The request for descretion is intended not to hide info from the public, but rather to prevent rumors and misinformation from being generated and spreading which can create unnecessary and unintentional stress and duress for the victim or their family and friends.
Unfortunately even the most innocuous seeming details can carry unintended consequences (not merely legal, but also emotional), especially if they are mis-represented, mis-repeated etc.. With that in mind we want to continue to place the priority on respecting the privacy and sensitivites of the victims immediate family and friends. I am sure everyone can understand that.
It is also important to understand that the Courtroom Advocates have a specific purpose: to support the family, friends, witnesses and victims of crimes, in the courtroom, at that particular appearance, and to remind the judge, attorneys etc. that the public takes this crime seriously and is observing the proceedings.
They are not there to serve as conduits for information to the public, that is more in the perview of the media.
The hearings are a matter of public record and open to the public, anyone may attend and any member of the public may speak about what they've seen or heard. Media also has regularly attended the hearings and we hope to see future updates through media channels.
The 18th district CPD Community Office has given me the specific okay to post to most basic updates after each court appearance, which will, in all likelyhood, consisting of the outcome and the next date. I will post them in the other thread which has the majority of the related content.
Thank you all for your continued interest and support in this case. It is impossible to overstate how much it is appreciated by the Bobby's friends and family.

Next week, on Wednesday September 18th is the next scheduled court date for San Hamel who was alleged to be driving drunk, alleged to be speeding and alleged to have killed bicycle advocate Bobby Cann.

I don’t know the location (26th and Cal?), room number, or time – only the date that was set after the initial trial on August 2nd when he entered a “Not Guilty” plea. Perhaps Jason from Active Transportation Alliance can post more information – like the location and time of the pending trial.
Following the first trial there has been a dearth of information or discussion about the pending criminal trial. I don’t think many in the bicycle community want to see this dropped, neglected and forgotten. If we don’t keep up the discussion and following up, that’s what’s going to happen.
The Court Advocate Committee has been operating under a gag-order not to discuss the trial, so those of us on the outside this inner group (anyone is free to join the group but many cannot commit to the time and effort) won’t know much about what’s going on unless it is reported by somebody on the outside of the group.
So if anyone has accurate information about the trial on the 18th please post the information on the Chainlink or on the BIKE-CHI@LISTSERV.UIC.EDU mailing list. Some of the sections on the Chainlink have been closed to further discussion, so I don’t know where else more information is available.

The Court issued a formal "gag order" or is this simply an agreement among the group. I have real trouble with the whole concept of "gag orders" and "keeping information secret" involving trials. The whole Judicial System in the United States is set up to avoid Star Chamber (secret) proceedings and to operate in Sunshine. Court filings and arguments are open to the public. Many appellant Courts place the oral arguments on line to be heard. Justice works best in the sunshine and in the United States all Court hearings, with very rare exceptions, are open to the public. I find it troubling that people think that "hiding" the cases brings about real justice.

You guys, PLEASE read the whole thread. First off, nothing has happened so there is no big secret about how things are going.
David, here is a post from Jason Jenkins earlier in this thread that answers your questions/concerns.
Talking outside of a case about things involved a case while a case is being tried to the wrong people can compromise a case. It's simple.
