Chicago Cop Who Allegedly Struck Cyclist and Fled Is Acquitted of Felonies

An off-duty Chicago cop who apparently struck a female cyclist with his truck while drunk, fled the scene, and then lied about the incident on a police report, was acquitted of both felony charges he faced: leaving the scene of an accident and filing a false police report. However, last Thursday Cook County Judge James Linn did find Officer Michael Bergeson, 34, guilty of misdemeanor failing to provide aid and information at an accident involving injury.

On August 3, 2012, around 3:25 a.m., Nina Pilacoutas, 27, was cycling west home from her bartending job with boyfriend Clayton Meyer when they came to California and Wabansia, a skewed intersection with four-way stop signs. Bergeson was allegedly driving his Ford F150 pickup northbound on California when he blew a stop sign. Pilacoutas went over the hood of the truck and landed face-first on the pavement, suffering a concussion, facial injuries, broken bones in her feet, and bruises on her body.

Mitigating circumstances combined with a little 'professional courtesy' from the judge?

According to the article, the cop stopped and tried to help but the boyfriend wouldn't let him. The cop called 911 three times to report the accident and didn't leave until he knew EMS was on the way. The cyclist had been drinking and blew a stop sign and rode into traffic.

Consider: you're upset for a number of reasons but posted here because of a rather tenuous emotional attachment to the victim - a cyclist - and you want the driver whacked. I mean, this is the chainlink, right? The judge, too, has an emotional attachment to the case - he works with cops all day long - and doesn't want to whack the cop. He's supposed to be better than that but aren't we all?

Judge Linn is an Associate Judge, which means he's a second rate journeyman. It also means that we don't get to vote to retaining him. That sucks.

Easy, tiger. What I said was "according to the article" in order to point out that there were mitigating circumstances. You apparently have information about this accident that wasn't contained in the newspaper report. There were mitigating circumstances and your anger is misplaced.

At that intersection, heading east on Wabansia crossing California, there is a stop sign at California where the cyclist would turn right and then immediately left onto Wabansia again. When the cyclist is turning left onto Wabansia from California there is no stop sign. The left turning traffic has the right of way and the driver heading north "blew the stop sign" and struck the cyclist.

Don't spread lies.

No, tiger, the article states that the cop, who may have been drunk, filed a report claiming the cyclist disregarded the stop sign and rode into traffic.  Which sounds a lot to me like lying to cover his ass.

The article also only says that the boyfriend told him to stay away from the victim and wait; which he did not do.

The fact that the cyclist was drinking before, and that they were not wearing a helmet, are not really relevant to the situation at hand; having a drink after their shift does not mean they were impaired.
