i got hit by a car last week and did not get a police report. Yes, I KNOW I should have done that. I seemed fine, but my bike was a little hurt. I got the guys info. and now he says that  the charges seem to be high for what happened.  He said "I am not sure if these charges are from your spill or not. my SPILL? my SPILL? his car HIT me. I fell on the pavement and hit my head.

 

Learning lesson. get a police report. You live and you learn.

He's the one who hit you, but you're the one who took the spill.  The guy probably is trying to not fully own up to the fact that he hit you, but you did take a spill, albeit from getting hit by a car.
It's the word "spill" that he used. As if it was a soft landing after his fancy car hit me.  I would never nickel and dime someone.
Sounds like we have different criteria for what can be considered a "spill."

I guess it was a spill. but it just sounded so soft, especially after he mentioned that my bill may not have included damage related costs.
It was a crash. Don't let the driver downgrade what happened by using soft terms. A spill happens on a freshly waxed floor to waiters when a toddler drops a banana peel; a crash happens when an auto hits a cyclist.
