I agree with Jeff. I don't know what the law states. I would think if you were in a bike lane you might have a case but in a normal street situation one might be legally required to "que up".
I would not advise passing a moving vehicle at an intersection for exactly this reason. The same would be for non-signalling vehicle that is rapidly slowing down; that vehicle will probably turn.
You may be right, but don't be dead right....
