I can barely stand to think about this case, but here's a video with Chicago bike scene patron Tim Herlihy interviewed. He traveled out to Colorado because this mattered to him.

Falling asleep might "explain" (not excuse) hitting someone -but how can they say that he slept through hitting the guy, woke up sometime later, and never realized he was asleep and/or that anything untoward had happened while he was asleep?

 

Hit and run drivers are the lowest of the low.

Vail must be a very small place. The father-in-law of the victim is also a fund manager that knew Erzinger from business dealings. Bizarre.

And if someone suffers this severely from sleep apnea, seizure activity, any type of neurological anomaly which does or can result in even momentary loss of consciousness, etc. Secretary's of State typically revoke driver's licenses...

Unlike epilepsy, I doubt many doctors report their patients to the secretary of state or the DOT authorities every time they diagnose sleep apnea so that their DL's are restricted or suspended.

 

Just about everyone I know over the age of 60 has sleep apnea -none of them have had their DL's restricted or revoked.  It's a pretty darn common affliction amongst the typical over-weight American -although many are undiagnosed and/or go untreated.

 

If they did this they'd be pulling about the licenses of a large percentage of Americans.  There would be an uproar.

If the Attorney for Mr. Erzinger made the argument in Court that a possible explanation for the accident, separate and apart from being a self-absorbed doughboy who has no regard for the lives of others, than that argument would have needed to be supported by some medical evidence to support it.

I totally agree that he is a douchebag.  Any attempt to pass this off on sleep apnea as an "excuse" is totally derailed by the fact this douchebag didn't even bother to stick around and render aid to someone he just RAN THE FRAK OVER.

 

I mean, a HUMAN would stop and render aid regardless of who's fault it was.  That's what you DO.  This douche ran away and hid while some poor guy lay gasping and seriously injured at the side of the road alone and scared like some animal.

 

The douchebag should be hit with a car in the same way and left for the same amount of time as punishment.
